Komweer Terms of Service
Effective date: 13 Oct 2026 Version: t-2026-10.1
These terms govern your use of Komweer. Part A applies to everyone. Part B also applies to merchants, and Part C also applies to customers. By creating an account or using Komweer you agree to them. If you do not agree, do not use Komweer.
Please read the clauses in bold carefully. They limit our liability or place obligations on you.
Part A: Everyone
A1. About Komweer
Komweer is a digital loyalty service operated by Hexacon Investments (Pty) Ltd, registration number 2025/295261/07, of 41 Klopper Road, Centurion, South Africa ("Komweer", "we", "us").
- Email: hello@komweer.co.za
- WhatsApp: +27 71 493 0704
- Website: komweer.co.za
Merchants use Komweer to run digital stamp cards. Customers use a Komweer card to collect stamps and rewards from those merchants.
A2. Accounts
- Give accurate details, including your first name and surname, and keep them up to date.
- Keep your password, PIN and verification codes private. You are responsible for activity on your account unless you tell us promptly that it has been misused.
- You must be 18 or older, or have a parent's or guardian's permission, to use Komweer.
A3. Acceptable use
You may not:
- copy, forward, screenshot or share stamp or reward codes so that someone earns a stamp or reward they did not earn;
- create fake or duplicate accounts, or use someone else's number or email address;
- try to break, overload, reverse-engineer or get around Komweer's security, limits or rules;
- use Komweer to send spam or unlawful messages, or for anything illegal.
We may void stamps or rewards obtained this way, and suspend or close the accounts involved.
A4. Our content and brand
Komweer's software, design, logo and name belong to us. You may use them only as part of using Komweer. Merchants keep ownership of their own logos, names and content.
A5. Availability
We work to keep Komweer available, but we do not guarantee it will be uninterrupted or error-free. Outages can be caused by power cuts, network problems, maintenance or our service providers. Redemptions made offline in the merchant app are saved on the device and sync when the connection returns.
A6. Third-party services
Komweer relies on other providers, including Paystack, Meta (WhatsApp), SMS and email providers, Supabase, Cloudflare and Google. Their own terms also apply when you use them, and we are not responsible for their services.
A7. Liability
To the extent the law allows:
- Komweer is provided "as is". We are not liable for indirect or consequential loss, such as lost profit, lost business or lost data.
- Our total liability to a merchant for any claim is limited to the fees that merchant paid us in the 3 months before the claim arose. Our total liability to a customer is limited to R500.
Nothing in these terms limits liability that cannot lawfully be limited, including under the Consumer Protection Act where it applies, or for our fraud or gross negligence.
A8. Changes to these terms
We may update these terms. We will post the new version here with a new effective date, and give merchants at least 30 days' notice by email of any change that materially affects them. If you keep using Komweer after a change takes effect, the new terms apply. If you do not agree, you may close your account.
A9. Suspension and closure
We may suspend or close an account that breaches these terms, puts other users at risk, or where the law requires it. Where reasonable, we will warn you first and give you a chance to fix the problem.
A10. Privacy
Our Privacy Policy, at komweer.co.za/privacy, explains how we handle personal information and forms part of these terms.
A11. Law and disputes
South African law governs these terms. Please contact us first so we can try to resolve any dispute. If we cannot, the South African courts have jurisdiction, and you may also approach any regulator or ombud available to you.
A12. Notices
We send notices to the email address or mobile number on your account. You can send notices to hello@komweer.co.za or to our address above.
Part B: Merchants
B1. Plans
- Free plan: 1 stamp card, 1 branch, 1 device and up to 100 active customers, at no charge and without a card on file.
- Growth and Pro plans: the features and prices shown at komweer.co.za/#pricing when you subscribe.
- We may change plan features or prices with at least 30 days' notice by email. Merchants who joined through early access keep their launch price for as long as their subscription stays active without a break.
B2. Billing and payment
- Paid plans are billed in advance, monthly or annually, in South African Rand, through Paystack. Komweer is not registered for VAT, so no VAT is added to prices.
- Subscriptions renew automatically at the end of each period until you cancel.
- Card details are captured and stored by Paystack; Komweer never sees them.
- If a payment fails, Paystack retries it and we notify you. If it is still unpaid 7 days after the due date, your account moves to the Free plan. Your data is never deleted because of a failed payment.
- Message credits (SMS and WhatsApp) are prepaid, non-refundable once used, and do not expire while your account is open.
- You will receive an invoice for every payment, by email and in the merchant app.
B3. Cancellation and refunds
- You may cancel or downgrade at any time at app.komweer.co.za. The change takes effect at the end of the current billing period, and you keep paid features until then.
- Fees already paid are not refunded for partial periods, except where the law requires it.
- Annual plans may be cancelled before renewal. If you are a consumer under the Consumer Protection Act, your rights under section 14 still apply.
B4. Your rewards and your customers
- You decide your card rules and rewards, and you must honour every reward your customers earn under the rules that applied when they earned the stamps. Komweer applies rule changes only to stamps earned after the change.
- Your reward terms (what qualifies, expiry dates, limits) must be clear on your card and must comply with the Consumer Protection Act.
- You are responsible for your staff's use of Komweer, including keeping staff PINs private and removing staff who leave.
- You may send marketing only to customers who opted in for that channel and to your business, and only through lawful messages that include an opt-out.
- Do not record medical, health or other special personal information in customer notes or tags.
B5. Your data
- You own your business data and your customers' loyalty records. You can export your client list at any time.
- Within 90 days of closing your account you may export your data. After that we delete it, except records we must keep by law, such as billing records.
B6. Komweer as your operator (data processing terms)
For your customers' loyalty records, you are the responsible party and Komweer is your operator under POPIA. Komweer will:
- process that information only to provide Komweer to you and on your instructions given through the service, unless the law requires otherwise;
- keep it confidential and ensure our staff and service providers are bound to confidentiality;
- maintain appropriate security safeguards, as described in our Privacy Policy;
- notify you without undue delay if we believe it has been accessed or acquired without authority;
- use only the service providers listed in our Privacy Policy, under written contracts with similar protections, and tell you before adding a new one that processes your customers' information;
- help you respond to customers' requests to access, correct or delete their information;
- delete the information when your account closes, as set out in B5.
B7. Indemnity
You indemnify Komweer against third-party claims arising from rewards you fail to honour, marketing you send, or your breach of the law or of these terms.
Part C: Customers
C1. Your Komweer card
- Your card is free. You join a merchant's card by scanning its code and verifying your mobile number or email address once on each device.
- Each merchant's card is separate. Stamps from one merchant cannot be used at another.
C2. Rewards
- Rewards are offered and provided by the merchant, not by Komweer. Questions about a reward, what qualifies or whether it was honoured go to that merchant first. We will help where we can.
- Stamps and rewards have no cash value, cannot be exchanged for money and cannot be transferred. They may expire under the merchant's card rules, which are shown on your card.
- If a merchant closes its Komweer account or stops a card, unused stamps and rewards for that card may lapse. Merchants must honour rewards already unlocked, as B4 requires.
C3. Fair use
Stamps must be earned by real visits or purchases. Komweer and merchants may void stamps or rewards obtained by sharing codes or other misuse (see A3).
C4. Messages
Merchants may message you only if you opted in for that merchant and channel. You can change this on your card at any time, or reply STOP where offered.
C5. Closing your account
You can delete your Komweer account at any time from your card (My data). This removes your stamps and rewards at every merchant and cannot be undone.
